The motion to enforce settlement agreement and enter
judgment per CCP § 664.6
by Plaintiff Ilya
Nodel (“Plaintiff”) will have to be
continued again for the reasons set forth below.
On
August 1, 2022, the Court issued an Order on the instant motion indicating that
the Declaration of Elias
K. Fakhoury filed in support of the motion referenced several exhibits,
including an exhibit of the settlement agreement at issue, but that no exhibits
were attached to the declaration. In the August 1, 2022 Order, the Court ordered Plaintiff “to immediately file and serve the Declaration of Elias K. Fakhoury with the
exhibits attached.”
On August 4, 2022, Plaintiff filed the Declaration of Elias K. Fakhoury with the exhibits attached. However, no proof of
service was attached to the declaration. Thus, the declaration
does not appear to have been served.

In light of the foregoing, the Clerk will discuss a new
hearing date with the parties.
