RE: MOTION TO BE RELIEVED AS COUNSEL |

Lonnie D. Giamela of Fisher
& Phillips LLP (“Counsel”) moves to be relieved as counsel for Defendant
Treeium Inc.
The Court notes that while Counsel has provided sufficient reason for withdrawal, Item 6 of the
proposed order does not list Counsel’s client’s telephone number.
In
addition, the Court notes that after the instant motion was filed, an
application for order for appearance and examination was filed. The hearing on
the application is scheduled for January 10, 2023, but is not referenced in the
declaration or proposed order in support of the motion to be relieved as
counsel. The Court notes that pursuant to Cal. Rules of Court, rule 3.1362,
subdivision (e), “[t]he
proposed order relieving counsel…must specify all hearing dates scheduled in
the action or proceeding, including the date of trial, if known.”
The
Court will revised the proposed order to reflect the new hearing date and the
client’s telephone number if provided at the hearing. ¿
