RE: MOTION
TO TRANSFER AND COORDINATE RELATED CASE TO THIS COURT FROM ANOTHER SUPERIOR
COURT |

Defendant Farmers
Insurance Exchange moves for an order transferring the case Zia Abhari
v. Bacon-Up Corporation, Mazyar Yaghoubian, Farmers Insurance Exchange, Farmers Underwriters Association, Farmers
Group, Inc. and Does 1-1000, San Bernardino Superior Court Case No.
CIV SB 2200940 (the “Abhari Action”) to this Court, and coordinating the Abhari
Action with the instant case. The
motion is made “pursuant to Cal. Rules of Court Rules 3.300 and 3.500
and C.C.P. §§ 403 and 404.1 and on the grounds that this case and the Abhari
Action are related cases…” (Mot.
at p. 2:5-6.)[1]
The Court notes that on July
22, 2022, this Court issued a minute order indicating that “[t]he Court
finds that the following cases, 20STCV17320 and CIV SB 2200940, are not related
within the meaning of California Rules of Court, rule 3.300(a).”
In light of the
foregoing, the Court finds that the instant motion is moot.

Rules of Court, rule 3.300, subdivision (h)(2)(B), “[i]f it is determined that related cases pending in
different superior courts should be formally coordinated, the procedures
in Code of Civil Procedure section 403 and rule 3.500 must be
followed for noncomplex cases, and the procedures in Code of Civil
Procedure section 404 et seq. and rules 3.501 et seq. must be followed for
complex cases.”
