Beaudet hereby discloses that she is the trustor and sole beneficiary of a
trust that owns certain rental units.
Due to some water leaks earlier this year, it was determined that
surface mold had developed where the water had leaked. Inspections by a remediation company hired by
the trust found no difference between the air inside the units and the air
outside the units. The area where the mold was found has been or is being
replaced. No litigation is involved with these units. Judge Beaudet does not
believe that this situation will cause her to be biased for or against any party
in this case. Judge Beaudet does not
believe that there are any legal grounds for recusal, and she notes that she
has both a statutory and ethical duty to preside over any case in which she is
not disqualified. However, if you believe
differently, you will have until August 26, 2022, to file IN DEPT 50 (not
the filing window) and serve a verified statement of disqualification per
CCP §170.3(c)(1) (the “Statement”). If
you do not file and serve a Statement, grounds for recusal will be deemed
waived.
The hearing
on the Ex Parte Application is continued to August 30, 2022, at 10:00 a.m. in Department
50 unless both sides waive the right to
file the Statement. Plaintiff is ordered to give notice of this
Disclosure to any new parties who are added to the case and to file proof of
service of same promptly after service, with a courtesy copy delivered to
Department 50. Any new party has 14 calendar days from the date of service to
file and serve the Statement per section CCP 170.3.
