ORDER RE: MOTION TO BE RELIEVED AS COUNSEL |

June D. Coleman of
Messer Strickler Burnette, Ltd. (“Counsel”)
moves to be relieved as counsel of record for Plaintiffs “Nivo I, LLC,” D.A. Beec-007,
LLC, and “Anna” Kihagi.
The Court finds that Counsel has provided sufficient
reason for withdrawal. However, the moving papers reference “Anna
Kihagi,” while the Complaint and First Amended Complaint (“FAC”) in this matter
name “Anne Kihagi” as a plaintiff. (Emphasis added.) Further, the moving
papers reference “Nivo I, LLC” while the Complaint and FAC name
“Nivo-1, LLC” as a plaintiff. (Emphasis added.) Thus, it appears the
moving papers contain typos.
The Court also notes
that the proposed order (Form MC-053) lists the hearing date September 26,
2023. On September 25, 2023, the hearing on the instant motion to be relieved
as counsel was reset for hearing on January 9, 2024. (See September 25,
2023 Notice Re: Continuance of Hearing and Order.)
If Counsel provides the Court with a revised
order correcting the foregoing defects prior to the hearing, the Court will
grant the motion.¿
Counsel is ordered to give notice of this order.
