The motion for summary judgment or, in the alternative, summary adjudication of issues brought by Defendant Harvey Champlin (“Defendant”) will have to be continued for the reasons set forth below.

Plaintiffs C&M Investment Group, Ltd. and Karlin Holdings Limited Partnership (jointly, “Plaintiffs”) filed an opposition to the motion that contains redacted information. Pursuant to California Rules of Court, rule 2.551, subdivision (a), “[a] record must not be filed under seal without a court order.” 

Plaintiffs concurrently filed a Motion to File Under Seal Summary Judgment Opposition and Related Documents, which is noticed for hearing on March 24, 2023. This motion indicates that Plaintiffs move for an order to seal: (1) excerpts of their opposition to Defendant’s motion for summary judgment or, in the alternative, summary adjudication of issues; (2) excerpts of the Declaration of Dr. Gary Karlin Michelson in support of Plaintiffs’ opposition to Defendant’s motion for summary judgment or, in the alternative, summary adjudication of issues; (3) excerpts of the Declaration of Lauren Schweitzer in support of Plaintiffs’ opposition to Defendant’s motion for summary judgment or, in the alternative, summary adjudication of issues; and (4) excerpts of Exhibit 60 to the Schweitzer Declaration.

Based on the foregoing, the date of the hearing on Defendant’s motion for summary judgment or, in the alternative, summary adjudication of issues is continued to ____________, 2023, at 2:00 p.m. in Dept. 50.

Defendant is ordered to give notice of this Order.
