(“Counsel”) moves to be relieved as counsel of record for Defendant Polish
Investment and Trade Agency. 
Although
Counsel has provided sufficient reason for withdrawal, the proof of service
attached to the Notice of Motion and Motion to be Relieved as Counsel (Form
MC-051) states that the “Notice of Motion and Motion to be Relieved as Counsel”
were served on Plaintiff and Counsel’s client. However, it is unclear if the
supporting declarations and proposed order were also served. No proofs of
service are attached to either declaration or the proposed order. Pursuant to¿California Rules of Court, rule 3.1362, subdivision (d),
“[t]he notice of motion and motion, the declaration,¿and the proposed
order¿must be served on the client and on all other parties who have appeared
in the case.”¿
In addition, Item 5 of the proposed order (Form
MC-053) is blank. Further, Counsel’s client’s telephone number is not listed in
Item 6 of the proposed order. 
Because of the issues identified above, the
motion is denied without prejudice.
