RE: PLAINTIFF’S REQUEST FOR DEFAULT JUDGMENT |

Plaintiff Elm Terrace
Holdings, LLC (“Plaintiff”) requests entry of default judgment against Defendant
Snatch Media, Inc. dba Dealer
Preroll. Plaintiff seeks judgment in the total amount of $58,632.91, comprising $44,028.16 demanded in the Complaint,
$4,004.75 in interest, $600.00 in costs, and $10,000.00 in attorney fees.
The Court notes a number of defects with the submitted default
judgment package.
First, Plaintiff seeks
an award of attorney’s fees, but the amount requested is still in excess of the
schedule set forth in LASC rule 3.214(a).
Second,
Item 8 of the Request for Court Judgment (Declaration of nonmilitary status) is not signed. Pursuant to Cal.
Rules of Court, rule 3.1800(a)(5), a party seeking a default judgment must file “[a] declaration of nonmilitary status
for each defendant against whom judgment is sought.”
Third, Item 2 Request
for Court Judgment lists “10000”
as the amount requested in attorney fees, while the proposed judgment lists “10,000.00.”
Accordingly, the Court denies Plaintiff’s request for default judgment
without prejudice. The Clerk will discuss with Plaintiff a schedule for
resubmission of the default judgment package.
