TO CONFIRM ARBITRATION

Petitioner Dennis Michael Franklin (“Petitioner”) petitions the
Court to confirm an arbitration award issued on February
18, 2022. (Chang Decl., ¶ 9, Ex. E.)
The petition was filed on May 19, 2022. On July 26, 2022,
Petitioner filed a proof of service indicating that the petition, notice of
hearing on the petition, and related documents were served on Respondent Wells
Fargo Clearing Services, LLC (“Respondent”) on July 26, 2022 via e-mail. No
opposition to the petition was filed.
The Court notes that pursuant to Code of Civil Procedure
section 1005, subdivision (b), “[u]nless
otherwise ordered or specifically provided by law, all moving and supporting papers
shall be served and filed at least 16 court days before the hearing.” Pursuant to Code of Civil Procedure section
1010.6, subdivision (a)(4)(B), the notice period is extended by two court days
when service is made by electronic means. Therefore, the petition,
notice of hearing on the petition, and the related documents must have been served electronically by July
11, 2022.
Based on the foregoing, the hearing on the petition is continued from August 4, 2022 to
_______________, 2022, at 10:00 a.m., in Dept. 50. The Court orders Petitioner to file the petition, notice of
hearing on the petition, and related documents and serve these documents on Respondent with the requisite statutory notice per Code of Civil Procedure section 1005, subdivision (b). Any opposition and reply papers must be filed and
served per Code of Civil Procedure section 1005, subdivision (b).
Petitioner is ordered to provide notice of this Order.
