DEMURRER OF CROSS-DEFENDANT JACQUELINE J. DMEZA TO CROSS-COMPLAINT OF CROSS-COMPLAINANTS ADIEL SOTO AND ANGELICA SOTO;

 

MOTION TO STRIKE PUNITIVE DAMAGE REQUEST FROM CROSS-COMPLAINT OF ADIEL SOTO AND ANGELICA SOTO

 

AND RELATED CROSS-ACTION

 

On January 18, 2022, Plaintiff Jacqueline J. D’Meza (“D’Meza”) initiated the instant action against Defendants Adiel Soto and Angelica Soto. On February 22, 2022, Adiel Soto and Angelica Soto (jointly, “Cross-Complainants”) filed a Cross-Complaint against D’Meza, asserting causes of action for (1) civil harassment (CCP § 527.6); (2) intentional infliction of emotional distress; (3) negligent infliction of emotional distress; and (4) nuisance. 

D’Meza demurs to each of the causes of action of the Cross-Complaint. D’Meza also moves to strike the punitive damage request from the Cross-Complaint. No opposition to the demurrer or motion to strike was filed. However, the Court notes that on August 2, 2022, Cross-Complainants filed a First Amended Cross-Complaint. Accordingly, D’Meza’s demurrer to the Cross-Complaint and motion to strike the punitive damage request from the Cross-Complaint are moot.
