Beaudet hereby discloses that the law firm of McNicholas & McNicholas is
representing a person who, as of December 8, 2021, has been staying with her
and her husband, and he will be staying with them for the foreseeable future
while the case is being resolved. He is
represented by the McNicholas firm in connection with the Malibu fire in Case
20STCV22089. His case is part of a
co-ordinated case over which Judge Highberger is presiding.
Judge Beaudet does not believe that the
situation described above will cause her to be biased for or against any party
in this case. However, if you believe
differently, you will have until February 7, 2023 to file IN DEPT 50 and
serve a verified statement of disqualification per CCP 170.3(c)(1) (the
“Statement”). If you do not file and
serve a Statement, grounds for recusal will be deemed waived. The pending Case Management Conference is continued
to February 14, 2023 at 10:00 a.m. in Department 50 unless both
parties waive the right to file the Statement. Plaintiff is ordered to give
notice of this Disclosure to any new parties who are added to the case and to
file proof of service of same promptly after service, with a courtesy copy
delivered to Department 50. Any new party has 14 calendar days from the date of
service to file and serve the Statement per section CCP 170.3.
Plaintiff is ordered to give notice of this Disclosure and Order.
