Cross-Complainant
Enigma Management Corp., a New York corporation dba Alliance Laboratories (“Cross-Complainant”)
requests entry of default judgment against Cross-Defendant The Testing Company
LLC in the total amount of $506,083.85, which includes $475,239.75 demanded in
the Complaint, $29,620.50 in prejudgment interest, $0 in attorney fees, and $1,223.60
in costs. (See CIV-100.) Cross-Complainant filed a
case summary, dismissed Roes 1-10, and filed a declaration in support of the
application.
However,
the Court finds that the Cross-Complainant’s application is deficient because the declaration of nonmilitary status in CIV-100
is blank. (See CIV-100, ¶8.) Additionally, the JUD-100 form is outdated as it
was last revised on January 1, 2024. The appropriate JUD-100 form was revised
on January 1, 2025 because the instant application was filed on January 17,
2025. Moreover, there is a discrepancy between the total amount in the JUD-100
form and the CIV-100 form.
Based on the foregoing, the court DENIES WITHOUT
PREJUDICE the request for default judgment. At the hearing, the Court will discuss
a new date for Plaintiff to submit a revised default judgment package.
