    DISCLOSURE AND ORDER

 

           

Judge Beaudet hereby discloses that in October 2022, Ms. Kim asked if she would be willing to serve as a reference for Ms. Kim’s application for Vice Chair of the ABA Litigation Section for the 2023-24 period based upon Ms. Kim’s work in the two-week bench trial in the case of Kyung Ku Cho, Avalon Land Co., LLC and 435 Los Felix LLC v. Wilshire Equity Partners Group, Inc., Case No. BC456112. Judge Beaudet agreed and a representative from the ABA Litigation Section’s Advisory Committee on Nominations called her and asked her to describe the work she did on the case, which she did. The conversation lasted a minute or two.

Today, Judge Beaudet received an email inquiry from someone on behalf of a member of the ABA Section of Litigation Advisory Committee regarding her purported support of Secretary Candidate Helen B. Kim.  Judge Beaudet has not responded to that email and she has not previously indicated that she was “supporting” Ms. Kim nor did she agree to give a reference for a Secretary position.

Judge Beaudet hereby further discloses that in August 2020, Ms. Kim asked if she would be willing to serve as a reference in connection with her judicial application for the Los Angeles Superior Court.  Judge Beaudet agreed but has no recollection of ever being contacted by anyone in connection with the reference.

 Judge Beaudet does not believe that her conversation with the ABA representative or her agreeing to serve as a reference for Ms. Kim will cause her to be biased for or against any party or their counsel in this litigation.  However, if you believe differently, you will have until April 3, 2023, to file and serve a verified statement of disqualification per section CCP 170.3(c)(1) (the “Statement”).  If you do not file and serve a Statement, grounds for recusal will be deemed waived. The hearing on the Case Management Conference has been continued to April 12, 2023, at 10:00 a.m. in Department 50. Plaintiff is ordered to give notice of this Disclosure to any new parties who are added to the case and to file proof of service of same promptly after service, with a courtesy copy delivered to Department 50. Any new party has 14 calendar days from the date of service to file and serve the Statement per section CCP 170.3.
