[TENTATIVE] ORDER RE: 

 

PLAINTIFF’S REQUEST FOR DEFAULT JUDGMENT

 

           

Plaintiff United States Surety Company (“Plaintiff”) requests that the Court enter default judgment against Defendants (1) Cleveland Z Taylor aka Cleveland Zackary Taylor aka Z. Zachary Taylor aka C. Zachary Taylor aka Zachary Taylor aka Zachary Cleveland, and (2) Clint Brannon aka Clinton Brannon aka Clinton McClung Brannon aka Brannon Clint. Plaintiff seeks judgment in the total amount of 118,624.44, comprising $75,000.00 demanded in the Complaint, $40,429.96 in interest, $804.48 in costs, and $2,390.00 in attorney fees.

The Court finds that Plaintiff has sufficiently supported its request with the submitted declarations and evidence.

However, the Court notes that Item 5(a) of the proposed judgment lists the name “American Contractors Indemnity Company” next to plaintiff. This appears to be an error, as the Plaintiff in this action is United States Surety Company.

In addition, Plaintiff appears to seek judgment against Does 1 through 75. (See Attachment 5(a) to the Proposed Judgment). However, Plaintiff filed a request for dismissal on June 13, 2023 as to Does 1 through 75, and dismissal was entered on June 20, 2023.

Plaintiff may file a revised Form JUD-100 prior to the hearing. If the above-referenced defects are corrected before the hearing, the Court will grant Plaintiff’s request.
