[TENTATIVE] ORDER RE: MOTION TO BE
RELIEVED AS COUNSEL |
Nineli Sarkissian (“Counsel”) moves to be
relieved as counsel of record for Plaintiff Martin Armando Haro (“Plaintiff”).
Counsel filed the requisite court forms, and
there does not appear to be any risk of prejudice to Plaintiff. However, the
following defects appear in Counsel’s filings:
1. Counsel states the client was served by
mail after verification of current mailing address, but does not state how the
address was verified. (MC-052, ¶ 3(b).) The proposed order then states the
client was personally served. (MC-053, ¶ 3(a).) A correct, compliant method of
service must be established.
2. Also, Counsel filed no separate proof of
service showing that Plaintiff and all other parties were served with
the motion, the declaration, and the proposed order. (CRC 3.1362(d).)
Accordingly, Counsel’s motion is denied
without prejudice. Counsel is ordered to
give notice of this ruling.
