Plaintiffs
Victoria Becerra and Maritza Martinez Becerra – the latter through Victoria
Becerra as her guardian ad litem – sued defendants Mi Linda Guatemala, Inc. and
Edgar Leonel Catalan on July 29, 2024, for motor vehicle negligence.
The
Court entered defendant Catalan’s default on March 10, 2025. Plaintiffs have
dismissed Mi Linda Guatemala. Plaintiffs now request default judgment against
Catalan for $71,975.54 (for Victoria) and $20,675.00 (for Maritza). They claim
no interest, fees, or costs.
The
Court will continue the hearing on Plaintiffs’ request for submission of
further evidence in support of Plaintiffs’ pain, suffering, and emotional
distress damages. Maritza Becerra suffered only $675.00 in medical expenses,
but claims $20,000.00 in total for pain, suffering, inconvenience, and
distress. Victoria Becerra’s declaration does not establish what injury or
distress was caused to Maritza. Similarly, although Victoria suffered physical
injury supported by the evidence, she has not explained how she suffered
additional distress warranting $40,000.00 in damages.
The
Court continues the hearing to _____________________, 2025. Plaintiffs may
submit supplemental evidence (and/or amended JUD-100 forms as appropriate)
without re-submitting all default prove-up materials.
