Background
Plaintiff Abigail Katz (“Plaintiff”) filed this action on November 21,
2024 against a number of defendants, including Nicholas Gerber (“Gerber”).
Plaintiff’s Complaint alleges twelve causes of action.
On
December 27, 2024, Gerber
filed a Verified Answer to the Complaint.
Plaintiff
now demurs to certain affirmative defenses alleged in Gerber’s Verified Answer to the Complaint. Plaintiff also moves
to strike portions of Gerber’s Verified Answer to the Complaint. No opposition to the demurrer or motion to strike was
filed. However, the Court notes that on February 14, 2025, Gerber filed
an Amended Verified Answer to the Complaint.
Discussion
As
set forth above, on February
14, 2025, Gerber filed an Amended Verified Answer to the Complaint. Accordingly,
Plaintiff’s demurrer and motion to strike pertaining to Gerber’s
Verified Answer to
the Complaint are moot.[1]
Gerber shall give notice of this
ruling.
