[TENTATIVE] ORDER RE: 

 

MOTION TO CONSOLIDATE ACTIONS FOR TRIAL

 

 

           

Plaintiff Brian Lam moves to consolidate the instant case with Playa Villa Montecitos LLC v. Brian Lam, et al., Case No. 24SMUD03072 (“the Playa Villa Action”). However, the defendant has not yet been served and appeared in this matter.

            CCP § 1048 grants trial courts the authority to consolidate actions “involving a common question of law or fact. (CCP § 1048(a).) Courts are given broad discretion for their decisions to consolidate. ((Fellner v. Steinbaum (1955) 132 Cal.App.2d 509, 511.) Moreover, “A motion to consolidate under section 1048 of the Code of Civil Procedure is predicated on the assumption that two or more actions already ‘involv[e] a common question of law or fact.’" (Askew v. Askew, (1994) 22 Cal.App.4th 942, 964 [quoting CCP § 1048].)

Here, this Court previously ruled that Case No. 25STCV05669 and Case No. 24SMUD03072 were not related. (Minute Order, 03/27/2025.) Because this Court has already determined that these actions are not related, there is no reason to consolidate these actions.

Thus, Plaintiff’s motion to consolidate Case No. 25STCV05669 and Case No. 24SMUD03072 is DENIED.
