[TENTATIVE] ORDER RE: 

 

PLAINTIFF’S REQUEST FOR DEFAULT JUDGMENT

 

           

Plaintiff Los Angeles Unified School District (“Plaintiff”) requests entry of default judgment against Defendant Kerry Brooks (“Brooks”). Plaintiff seeks judgment in the total amount of $25,891.04, comprising $13,246.60 in damages, $12,582.44 in interest, and $62.00 in costs. Plaintiff also seeks daily damages of $3.6292 per day beginning on March 23, 2023.  

The Court notes that Plaintiff seeks $13,246.60 in damages against Brooks. (See Request for Court Judgment, Item 2(a); Proposed Judgment, Item(6)(a)(1).) However, in the Complaint, Plaintiff alleges that Brooks’s overpayment balance is in the amount of $13,229.93. (Compl.,      ¶ 11, p. 6:15.)

The Court notes that “[a] complaint…shall contain…the following:…(2) A demand for judgment for the relief to which the pleader claims to be entitled.¿ If the recovery of money or damages is demanded, the amount demanded shall be stated.” (Code Civ. Proc., § 425.10, subd. (a).) Code of Civil Procedure section 580, subdivision (a) “limits a trial court’s jurisdiction to grant relief on a default judgment to the amount stated in the complaint.” (Dhawan v. Biring (2015) 241 Cal.App.4th 963, 968.) “[I]n all default judgments the demand sets a ceiling on recovery.” (Finney v. Gomez (2003) 111 Cal.App.4th 527, 534.)  

Based on the foregoing, the Court denies Plaintiff’s request for default judgment without prejudice. Plaintiff is ordered to refile and serve the default judgment package on or before ____________. The hearing thereon is set on ____________ at 10:00 a.m. in Dept. 50.
