The unopposed Motion to be Relieved as Counsel of Record, filed by Michael Winsten of the Winsten Law Group as to the representation of defendant Richard Cohen, primarily complies with C.R.C. 3.1362.  But moving counsel has failed to adequately demonstrate compliance with C.R.C. 3.1362(d)(1) and (2).  

Moving counsel should be prepared to address, at the time of the hearing, what specifically was and was not done to ensure that the client was duly notified of this motion.  For example, did counsel try to call and to email the client to confirm his current contact information? What was reviewed from the dissolution case to lead moving counsel to assert that the contact information provided here is current and correct, and why is that sufficient here?  Why is there no phone number listed for Mr. Cohen on the proposed order at ¶ 6?
