Judge: Theodore R. Howard, Case: 15-813279, Date: 2023-05-18 Tentative Ruling

The Motion for Entry of Judgment, filed on 10/3/22 by Plaintiff Lauralin Debra Anderson Pouliot (“Pouliot”), requesting entry of judgment against Richard Cohen (“Cohen”), as supplemented on 4/10/23 in ROA 129, is GRANTED.

The Motion, as now supplemented, reflects that: (a) the parties entered into a settlement agreement requiring payment to Plaintiff, by Cohen, in agreed installments: in the event of a default, Cohen was to be given notice thereof, and that if Cohen then failed to timely cure the default, judgment should be entered in the amount of $50,000, less credit for all payments that were made per the settlement; (b) Cohen defaulted after making only $11,000 of the required payments, and failed to cure the default after being given notice thereof; and (c)  Judgment should thus now be entered in favor of Plaintiff and against Cohen in the amount of $39,000.

Counsel for Pouliot is to submit a proposed judgment which comports with the foregoing and give notice of this ruling.
