Judge: Theodore R. Howard, Case: 18-1000570, Date: 2022-12-01 Tentative Ruling

The Motion filed by Plaintiff International Trading Firm, LLC (“ITF”) to continue trial, which was filed as an ex parte application on 10/26/22, is GRANTED IN PART.  

 

ITF’s counsel has shown that good cause exists to request some relief under CRC 3.1332(c)(3), in light of his current health issues. However, a six-month delay would be unreasonable here, as this case has already been pending for well over 5 years, and ITF’s counsel has already repeatedly requested relief due to ongoing health concerns. Under the circumstances, in accordance with CRC 3.1332 (d)(10), ITF must immediately obtain additional or alternate counsel.  The Court will continue trial to 1/3/23, to allow ITF time to do so.  However, the continuance is as to the trial date alone, and shall not extend any deadlines or statutory limits that have run or may run in the interim. ITF should anticipate that further trial delays will not be permitted and should plan accordingly.
