This is a motion by self-represented defendant Catherine Wolcott seeking a dismissal with prejudice. Since the motion was filed, plaintiff dismissed Ms. Wolcott without prejudice. Moving party still wants the motion with prejudice.

In examining the moving papers, the Court notes that the Memorandum of Points and Authorities practically exclusively rests on federal rules and case law. The only exceptions to this are citations to CCP sec. 430.10 {having to do with the grounds for a demurrer) and sec. 128.5. Neither of these provide a basis for the relief sought.

The Motion is DENIED.
