The Motion to Bifurcate, filed by defendant Monroe Capital Management Advisors, LLC (“Monroe”) on 4/14/23, is DENIED.
The Motion asks the Court to order bifurcation, to require Plaintiff’s alter-ego claims to be tried first. But Monroe has not shown that bifurcation would be conducive to expedition and economy or that the convenience of witnesses, the ends of justice, or the economy and efficiency of handling the litigation would be promoted thereby. Instead, Plaintiff’s claims as to whether Monroe should be liable on an alter-ego theory appear to be so entwined with the rest of the case that bifurcation would be inefficient and unwieldly. (See FAC ¶¶ 4, 12-14, 39-44.) The Motion is therefore DENIED.
