Attorney Christopher E. Delaplane seeks to be relieved as counsel of record for defendant Ace-Tech Construction (“Ace-Tech”). For the reasons set forth below, the hearing is CONTINUED to December 15, 2022, at 1:30 p.m. in this department.

On the merits, there appears to be good cause to grant the relief requested. However, there is a notice issue as to the client/defendant. The motion was originally noticed for hearing on October 6, 2022, but was continued on the court’s motion to November 10, 2022. (ROA 115.) There is no indication in the court’s files that attorney Delaplane provided notice of the continued hearing date to Ace-Tech. Thus, the court will continue the matter as indicated above to ensure that Ace-Tech receives proper notice of the hearing on this motion.

Attorney Delaplane is ordered to file and serve an amended Notice of Motion listing the correct date, time and location of the hearing, as well as file a proof of service of same on the client and all parties to this action at least five court days prior to the hearing.
