Judge: Theodore R. Howard, Case: 21-11990274, Date: 2022-12-08 Tentative Ruling
Motion to Compel Further Response to Requests for Admission and for Sanctions
Plaintiff Roy Lopez Castillo, Jr., moves for an order compelling defendant Local Air Conditioning Company to serve a further response to the first set of requests for admissions and imposing a monetary sanction of $1750 against this defendant.
Plaintiff seeks supplemental answers to only three requests in the set, i.e., requests 33, 34, and 35.
The requests ask for information that should clearly be within the knowledge of the representative of the defendant who is answering the requests and the answers are not responsive. Supplemental answers should be compelled.
The motion of plaintiff Roy Lopez Castillo, Jr., for an order compelling defendant Local Air Conditioning Company to serve a further response to the first set of requests for admissions that contains supplemental answers to requests 33, 34, and 35 and imposing a monetary sanction against this defendant is granted. Monetary sanctions are reduced to $600.

(“A motion concerning interrogatories, inspection demands, or admission requests must identify the interrogatories, demands, or requests by set and number.”)
The motion of plaintiff Roy Lopez Castillo, Jr., for an order compelling defendant Local Air Conditioning Company to serve a further response to the first set of form interrogatories and imposing a monetary sanction against this defendant is DENIED.
