Defendant/Cross-Complainant, Holly Mallick’s (“Defendant”) Motion for Leave to File an Amended Cross-Complaint is DENIED without prejudice.

On 09/15/22, the motion came on for hearing at which time the court continued the matter to 10/20/22 because the moving papers failed to include a copy of the proposed amended pleading and thus failed to comply with the procedural requirements of Cal. Rules Ct., rule 3.1324. Defendant was ordered to file the proposed amended pleading 9 court days prior to the continued hearing. (ROA 61.)

To date, no proposed amended pleading has been filed. Because nothing has been done to correct the procedural deficiency noted in the court’s 09/15/22 ruling, the motion is DENIED without prejudice.
