The unopposed Motion filed by Defendant ExportTek, Inc., seeking pro hac vice admission in this action for David Rubenstein, Esq., primarily complies with C.R.C. 9.40.  However, it does not demonstrate that moving party has complied with C.R.C. 9.40(c)(1) or 9.40(e) – that the Application was duly served on the State Bar of CA and that the application fee to the State Bar of CA was paid. The Court therefore will GRANT, upon submission of a declaration confirming that the Application was duly served on the State Bar of CA and that the application fee to the State Bar of CA was paid.  If moving party cannot so confirm, the Motion will be denied, without prejudice to a renewed motion demonstrating full compliance with C.R.C. 940.
