Plaintiff Deepak Krishan’s (“Plaintiff”) unopposed Motion to Enforce Settlement Agreement (“Motion”) is GRANTED.

 

Plaintiff and defendant Giri Rathnakishore (“Defendant”) entered into a Settlement Agreement (“Agreement”) to settle the present matter in or around 02/23/22. (Zeif Decl. Ex. A.)  The terms of the Agreement were certain and definite (Bustamante v. Intuit, Inc. (2006) 141 Cal. App. 4th 199, 209.) and include, among other things, that Defendant was to pay 1 Bitcoin within 10-days of the execution of the Agreement (with a seven-day grace period).  (Zeif Decl. Ex. A at p. 2 ¶ 2.)  If Defendant failed to make the initial or subsequent payments, the Plaintiff could move to enter judgment against Defendant and in favor of Plaintiff in the amount of $637,265.80.  As of 03/25/22, Defendant failed to make the required payments and there is no evidence before this court to show otherwise. 

 

The court hereby grants the Motion pursuant to Civ. Proc. Code § 664.6 and will sign the proposed judgment t in favor of Plaintiff in the above noted amount.
