Attorney Oliver Yang moves to appear pro hac vice for defendant Wilson Sporting Goods Company.
The motion primarily complies with C.R.C. 9.40. Application is verified and/or supported by declarations of attorneys Oliver Yang, Shelby Crawford and Daniel Hurwitz. It properly sets forth the applicant’s residence and office addresses and California counsel’s contact information. It states the applicant’s courts to which he is admitted and attests to his good standing. The application states he has only appeared in one other case in California the last two years. The motion has been filed and approved with the State Bar of California at its San Francisco address and Attorney Daniel S. Hurwitz attests that the application fee has been paid. Cal. R. Ct. 9.40(c)-(e).
However, application is missing the following two items: (1) Oliver Yang’s dates of admission to the State Bar of Illinois (9.40(d)(2)) and (2) the date of Oliver Yang’s application to appear pro hac vice in the Leadfactors, LLC case in Santa Clara and whether he has made any other applications to appear pro hac vice in the past two years (9.40(d)(5)).
The Court therefore CONTINUES the hearing to October 27, 2022 to allow submission of a declaration of Oliver Yang stating his date of admission to Illinois State Bar and stating the date of the pro hac vice application in the Leadfactors, LLC case as well as confirming there have not been any other applications made in the past two years. If moving party cannot do so within 7 days, the Motion will be denied, without prejudice to a renewed motion demonstrating full compliance with C.R.C. 940.
