MOTION TO COMPEL FURTHER RESPONSES TO REQUESTS FOR PRODUCTION (SET ONE)

STATEMENT OF MATERIAL FACTS AND/OR PROCEEDINGS:

           

            This is an employment law action for sexual harassment and retaliation that was filed on September 21, 2020. Plaintiff alleges that she was sexually harassed by her supervisor, and that her employers refused to investigate or take action, permitting the supervisor to retaliate against her for her complaints.

 

Plaintiff moves to compel further responses to requests for production propounded to Defendant Ralph’s Grocery Co.

           

TENTATIVE RULING:

 

On November 21, 2022, the Court ordered the parties to file a joint statement of the status of this discovery dispute. The parties filed their statement on December 9, 2022.  In that statement, the parties agreed to the following:

 

Plaintiff would withdraw Request for Production No. 14 and propound new tailored requests in its place.

 

Defendants agreed to produce deposition transcripts where Keith Henry and Sadira McFarland are alleged to be bad actors while employed at the Compton Creamery, in response to Requests for Production Nos. 31, 32, 56, and 57. All responsive documents in Defendants’ possession, custody, or control are to be produced by December 23, 2022.

 

The parties agreed that the motion is to remain on calendar until all responsive documents are produced and request a hearing based on the Court’s first availability after December 23, 2022.

 

Accordingly, Plaintiff’s motion is CONTINUED to January 3, 2023, at 1:30 PM for rescheduling purposes only. If this matter remains in dispute by that time, the Court will set the matter for further hearing.

 

            Moving Party to give notice.
