STATEMENT OF MATERIAL FACTS AND/OR PROCEEDINGS:

            This is an action for fraud that was filed on April 11, 2023. Plaintiff alleges that Defendants fraudulently induced him to purchase a parcel of real property for $3,000,000 by significantly misrepresenting the square footage of the property.

Plaintiff demurs to the answer of Heather Gussman.

TENTATIVE RULING:

Plaintiff demurs to the answer of Heather Gussman. This demurrer was filed and served on September 6, 2023. On November 21, 2023, Plaintiff filed a request for dismissal without prejudice as to Heather Gussman. Dismissal was entered on November 22, 2023

            Accordingly, Plaintiff’s Demurrer to the Answer of Heather Gussman is MOOT.
