moves for consolidation of this case with several other pending actions, or, in
the alternative, for permission to file a petition for coordination and a stay
of the action pending coordination.
Petitions for coordination
pertain to the management of civil actions in different courts sharing
common questions of fact or law. (See Code Civ. Proc. Sec. 404.) Here, however,
all of the actions with which the motion is concerned are pending before the
Superior Court of California for the County of Los Angeles—i.e., before one
court, not different courts. Coordination is therefore not an appropriate
remedy for the issues presented by this motion. As to the request for
consolidation, that measure is only available once all cases which are
purportedly related are in fact deemed to be related. (Los Angeles Superior
Court Local Rule 3.3(g).) Moreover, the motion must be filed in and heard by
the judge in the lead case—i.e., the oldest case on file, which in this matter
is Randall v. Kim, et al., Case No. 24STCP01314, pending in Stanley Mosk
Department 38. (See Cal. Rules of Court 3.350(a).) Thus, if the cases are not
deemed related, the Court has no power to grant this motion, and, even if they
are deemed related, the motion for consolidation would have to be heard in the
court with the lead case, not in Department 47.
Accordingly, Defendant UMRO
Realty Corp.’s Motion to Consolidate or for Permission to Permit Filing of
Petition for Coordination is DENIED.
