[TENTATIVE] ORDER TAKING MOTION FOR ATTORNEY FEES OFF CALENDAR

On April 5, 2021, Plaintiffs Susana Ramis, Brenda Love, and Lavern Cade filed a second amended petition for writ of mandate.

On December 3, 2021, the Court in Department 86 granted the petition in part, and the unresolved issues were transferred to Department 48.

On June 6, 2022, the parties filed a settlement agreement with a stipulation for the Court to retain jurisdiction under Code of Civil Procedure section 664.6.  Under the parties’ settlement agreement, if the parties did not settle the attorney fees, they would file a motion before Judge Mitchell L. Beckloff, the judge who ruled on the writ of mandate issues related to the attorney fees.

On October 3, 2022, Plaintiffs filed a motion or attorney fees, noticing a January 20, 2023 hearing before Judge Mitchell L. Beckloff in Department 86.

On December 20, 2022, the parties stipulated to continue the hearing on attorney fees.  The stipulation was presented for Judge Mitchell L. Beckloff in Department 86.  However, when the stipulation was signed, the department was inadvertently changed to Department 48.

Accordingly, the Hearing on Motion for Attorney Fees is OFF CALENDAR.

Plaintiffs are directed to contact Department 86 to reserve a new hearing date for their motion in that department.

Parties who intend to submit on this tentative must send an email to the Court at SMCDEPT48@lacourt.org indicating intention to submit.  Parties intending to appear are encouraged to appear remotely and should be prepared to comply with Dept. 48’s new requirement that those attending court in person wear a surgical or N95 or KN95 mask.
