[TENTATIVE] ORDER CONTINUING MOTION TO COMPEL COMPLIANCE WITH SUBPOENA

On August 16, 2024, Plaintiff Rafael Rodriguez Maldonado filed a motion to compel non-party Epoca Atlantic LLC’s compliance with a Deposition Subpoena for Production of Business Records.  Plaintiff rescheduled the hearing date several times.

Neither the original motion nor the most recent Notice of Continued Motion were served on Epoca Atlantic LLC.  The most recent Notice, filed on December 11, 2024, reflects electronic service on counsel for Defendants/Judgment Debtors Nina’s Cafe Inc. and Nina’s Cafe Bar Inc., as well as non-party Jorge Gamboa.  A Proof of Personal Service was also filed for personal service on Jorge Gamboa on December 3, 2024.

The Hearing on Motion to Compel Compliance of Epoca Atlantic, LLC with Deposition Subpoena for Business Records is CONTINUED to March 11, 2025 at 8:30 a.m.

Plaintiff is ORDERED to serve his motion and a copy of this order on Epoca Atlantic LLC at least 16 court days before the continued hearing.  (Code Civ. Proc., § 1005, subd. (b).)
