[TENTATIVE] ORDER DENYING PLAINTIFFS’ MOTION
TO COMPEL COMPLIANCE WITH COURT ORDER Dept. 48 8:30 a.m. November 15, 2022 |
On August 5, 2021, Plaintiffs
Angelica Reyes and Eladio Reyes filed this action against Defendant Jaguar Land
Rover North America, LLC.
On
November 22, 2021, Plaintiffs propounded a First Set of Requests for Production
on Defendant. (Powell Decl. ¶ 4.) Defendant provided responses on February 9, 2022. (Powell Decl. ¶ 4.) On April 14, 2022, the parties participated in
an Informal Discovery Conference, where they agreed that Defendant would produce
documents by June 14, 2022. Defendant requested
numerous extensions of time from Plaintiffs to produce the documents, but as of
September 9, 2022, they had not done so.
(Powell Decl. ¶ 7.)
On
September 9, 2022, Plaintiffs filed a motion to compel compliance with the Court’s
April 14, 2022 discovery ruling.
There
is no court order to enforce. The minute
order from April 14, 2022 states, “The Informal Discovery Conference is held telephonically
in chambers. The parties agree that Defendant
will produce documents by 06/14/2022.” While
the Court does sometimes make orders at IDCs, this is not one of those
cases. If Defendant still has not complied
with this agreement, the proper procedure would be to file a motion to compel further
responses in accordance with Code of Civil Procedure section 2031.310, subdivision
(a) and California Rules of Court, rule 3.1345.
Accordingly,
the motion to compel compliance is DENIED.

indicating intention to submit. Parties intending
to appear are encouraged to appear remotely and should be prepared to comply with
Dept. 48’s new requirement that those attending court in person wear a surgical
or N95 or KN95 mask.
