The
Ex Parte Application for Leave to File Plaintiff's Surreply in Response to Defendants’
Motion for Judgment on the Pleadings is GRANTED IN PART. Plaintiff is permitted to file a Surreply addressing
Defendants’ Reply arguments. However, the
Surreply is limited to 10 pages, not the 12 pages submitted as the Proposed Surreply. Plaintiff is ordered to file the Surreply no later
than December 29, 2023.
Defendants
may file a Sur-surreply (limited to 10 pages) addressing Plaintiff’s Surreply arguments
no later than January 12, 2024.
On
the Court’s own motion, the Hearing on Motion for Judgment on the Pleadings is CONTINUED
to February 8, 2024.
The
Final Status Conference scheduled for March 11, 2024 is CONTINUED to _________.
The
Non-Jury Trial (10 day estimate) scheduled for March 25, 2024 is CONTINUED to _________.
