[TENTATIVE] ORDER DENYING MOTIONS TO BE RELIEVED AS COUNSEL

Arman Matevosyan, counsel of record for Defendant/Cross-Complainant Armond Khosrovyan, seeks to be relieved as counsel.  (Counsel filed two motions for the same client.)  Counsel’s declaration states that the client has failed to communicate and failed to meet his obligations to counsel.

Absent a showing of resulting prejudice, an attorney’s request for withdrawal should be granted.  (People v. Prince (1968) 268 Cal.App.2d 398, 406.)  Counsel’s motion partially complies with California Rules of Court, rule 3.1362.  Trial is not until June 16, 2025, and there is no prejudice to Defendant/Cross-Complainant.

However, the proofs of service reflect service only on counsel for Plaintiffs, and no service on Defendant/Cross-Complainant.  Additionally, the MC-053 Proposed Order is incomplete.  Counsel must include the client’s current or last known telephone number, as well as all upcoming dates.

Accordingly, the motion is DENIED.

Parties who intend to submit on this tentative must send an email to the Court at SMCDEPT48@lacourt.org indicating intention to submit.  If all parties in the case submit on the tentative ruling, no appearances before the Court are required unless a companion hearing (for example, a Case Management Conference) is also on calendar.
