[TENTATIVE] ORDER DENYING MOTION TO STAY AS MOOT

On October 11, 2024, Defendant Volkswagen Group of America, Inc. filed a motion to stay all proceedings pending the Supreme Court’s decision in Everardo Rodriguez et al., v. FCA US, LLC.  On October 31, 2024, the Court issued its opinion.  The request for a stay is now moot.

In its Reply, Defendant acknowledges that its motion is moot, and it a requests a trial continuance to enable it to file a dispositive motion.  This is an improper new request on reply.

The motion to stay is DENIED AS MOOT.

Parties who intend to submit on this tentative must send an email to the Court at SMCDEPT48@lacourt.org indicating intention to submit.  If all parties in the case submit on the tentative ruling, no appearances before the Court are required unless a companion hearing (for example, a Case Management Conference) is also on calendar.
