On June 6, 2023, Plaintiff Miguel
Jonas Ruiz filed this action against Defendant Dothan Security, Inc.
On
August 11, 2023, Defendant filed a motion to compel arbitration.
On
October 20, 2023, the Court signed the parties’ Joint Stipulation and Order for
Binding Arbitration and Stay of Claims. The
stipulation provided that “[t]he Parties shall submit Plaintiff’s individual PAGA
claims to final and binding arbitration before a single neutral arbitrator pursuant
to the terms of the Arbitration Agreement,” and “[a]ll court deadlines, hearings,
discovery and proceedings shall be stayed until after the conclusion of the arbitration
of Plaintiff’s individual PAGA claim.”
Accordingly,
the Hearing on Motion to Compel Arbitration is taken off calendar.
A
Status Conference re: Arbitration is scheduled for ___________ at 8:30 a.m. in Department
48 at Stanley Mosk Courthouse. Five court
days before, the parties are to file a joint report stating the name of their retained
arbitrator and the status of arbitration.
Moving
party to give notice.
Parties
who intend to submit on this tentative must send an email to the Court at SMCDEPT48@lacourt.org
indicating intention to submit. If all parties
in the case submit on the tentative ruling, no appearances before the Court are
required unless a companion hearing (for example, a Case Management Conference)
is also on calendar.
