[TENTATIVE] ORDER CONTINUING MOTION TO COMPEL
FURTHER RESPONSES Dept. 48 8:30 a.m. April 3, 2025 |
On
February 28, 2025, Defendant DCH Torrance Imports Inc. filed a motion to compel
Plaintiff Ying Wang’s further responses to Request for Production of Documents (Set
One), Requests For Admission (Set One), Form Interrogatories – General, and Form
Interrogatories – Employment (CRS #: 824488311591).
Each
category of discovery (Requests for Production of Documents, Requests for Admission,
Form Interrogatories – General, and Form Interrogatories – Employment) should have been filed as a separate
motion, with separate filing fees and hearing reservations. Despite being scheduled as only one motion and
one hearing, the total substance is that of four motions. This unfairly allows Defendant to take only one
hearing reservation (instead of four) and results in an inaccurate projection and
accounting of the Court’s workload, inconveniencing both the Court and other litigants. All parties are ordered not to do this again
and are warned that continued action of this type may result in monetary sanctions
under Code of Civil Procedure section 177.5.
Because
of this calendar imbalance, the Court must continue the hearing.
The
Hearing on Motion - Other re Proposed Joint Statement re Defendant DCH Torrance
Imports, Inc.'s Motion to Compel Further Responses to and Compliance with Defendant's
Request for Production of Documents, Set One, Requests for Admissions, Set One,
and Form Interrogatories – General is CONTINUED to May 9, 2025 at 8:30 a.m.
Defendant
is ORDERED to pay three additional filing fees no later than May 5, 2025.
If
Defendant does not pay three additional filing fees before the continued hearing
date, the Court will deny the motion for being improperly filed. (See Code Civ. Proc., § 436, subd. (b).)

who intend to submit on this tentative must send an email to the Court at SMCDEPT48@lacourt.org
indicating intention to submit. If all parties
in the case submit on the tentative ruling, no appearances before the Court are
required unless a companion hearing (for example, a Case Management Conference)
is also on calendar.
