[TENTATIVE] ORDER CONTINUING PETITION FOR APPROVAL OF TRANSFER OF STRUCTURED SETTLEMENT PAYMENT RIGHTS

On May 1, 2023, Petitioner J.G. Wentworth Originations, LLC filed a Second Amended Petition for approval of transfer of structured settlement payment rights.  On May 7, 2024, Petitioner filed a Supplemental Exhibit E.

The transferee must comply with the notification requirements of subdivision (f)(2).  (Ins. Code, § 10139.5, subd. (a)(3).)  A notice of proposed transfer and petition must be filed and served no later than 20 days before the hearing and must include, among other things, a copy of the transferee’s current petition.  (Ins. Code, § 10139.5, subd. (f)(2).)

The operative Second Amended Petition was served by mail on May 1, 2024.  The Supplemental Exhibit E was served by mail and overnight mail on May 7, 2024.  This is insufficient notice in advance of the May 14, 2024 hearing.

The Hearing on Petition Notice of Hearing on Petition for Approval for Transfer of Payment Rights is CONTINUED to June 27, 2024 at 8:30 a.m.

Petitioner is ordered to file a proof of service of the Second Amended Petition (and all attachments/exhibits) no later than five court days before the hearing.

Parties who intend to submit on this tentative must send an email to the Court at SMCDEPT48@lacourt.org indicating intention to submit.  If all parties in the case submit on the tentative ruling, no appearances before the Court are required unless a companion hearing (for example, a Case Management Conference) is also on calendar.
