On January 18, 2024, Plaintiff
Chi Trinh filed this action against Defendant Vincent Mehdizadeh and others. The Court entered default against Defendant on
August 28, 2024.
On
October 23, 2024, Defendant filed a notice of motion to set aside the default. On December 19, 2024, Plaintiff filed a notice
of non-service of the motion.
Only
Defendant’s notice of motion was filed with the Court. Defendant did not file “the memorandum of points
and authorities to be filed separately, the declaration of Mainak D’Attaray to be
filed separately, and the proposed motion to compel arbitration” upon which the
motion is based. (See Notice at p. 4.)
Accordingly,
the Hearing on Motion to Set Aside/Vacate Default and Default Judgment (CCP 473.5)
as to Defendant Vincent Mehdizadeh is CONTINUED to March 11, 2025 at 8:30 a.m. All briefing deadlines are pursuant to code.
The
Order to Show Cause Re: Dismissal for Failure to Enter Default Judgment is also
CONTINUED to March 11, 2025 at 8:30 a.m.

Parties

indicating intention to submit. If all parties
in the case submit on the tentative ruling, no appearances before the Court are
