On March 29, 2024, Plaintiff Giancarlo Carmona filed this action against Defendant 8490 Hospitality LLC.

On May 31, 2024, Defendant filed a motion to compel arbitration and stay proceedings.

On November 13, 2024, Plaintiff filed a notice of non-opposition.  Plaintiff does not oppose the Court entering an order consistent with Defendant’s proposed order to compel Plaintiff’s individual PAGA claims to arbitration and to stay Plaintiff’s representative PAGA claims pending the outcome of arbitration.

Accordingly, the motion to compel arbitration is GRANTED.  The Court will sign Defendant’s proposed order.  This action is STAYED pending the completion of arbitration.

A Status Conference Re: Arbitration is scheduled for November 25, 2025 at 8:30 a.m. in Department 48 at Stanley Mosk Courthouse.

Parties who intend to submit on this tentative must send an email to the Court at SMCDEPT48@lacourt.org indicating intention to submit.  If all parties in the case submit on the tentative ruling, no appearances before the Court are required unless a companion hearing (for example, a Case Management Conference) is also on calendar.
