[TENTATIVE] ORDER TAKING HEARING OFF CALENDAR

On January 15, 2025, Petitioner Wells Fargo Advisors Financial Network LLC filed a petition to confirm the arbitration award issued after arbitration with Respondent Thomas Crider.

The same day, the Court issued a Notice of Hearing on Petition and ordered Petitioner to give Respondent notice of the April 24, 2025 hearing date.

On January 17, 2025, Petitioner filed its own Notice of Hearing for February 27, 2025, along with additional supporting documents.

According to the proofs of service, on January 27, 2025, Petitioner served Respondent with “Civil Case Cover Sheet, Civil Case Cover Sheet Addendum and Statement of Location, Petition, Notice of Hearing, Memorandum of Points & Authorities, Declaration of G Lee-Sanchez, Alternative Dispute Resolution Information Package, Notice of Case Assignment, Proposed Order, Proposed Judgment.”  On February 5, 2025, Petitioner served Respondent with “LOS ANGELES COUNTY SUPERIOR COURT’S NOTICE OF HEARING ON PETITION.”

Service of two Notices with different dates for the same Petition is unnecessarily inefficient and creates confusion for other parties.  Accordingly, today’s Hearing on Motion to Confirm Arbitration Award is OFF CALENDAR.

The Hearing on Motion to Confirm Arbitration Award scheduled for April 24, 2025 at 8:30 a.m. remains on calendar.

Parties who intend to submit on this tentative must send an email to the Court at SMCDEPT48@lacourt.org indicating intention to submit.  If all parties in the case submit on the tentative ruling, no appearances before the Court are required unless a companion hearing (for example, a Case Management Conference) is also on calendar.
