Background

 

According to Plaintiff’s complaint: Defendants are in possession of and using plaintiff's chassis and are incurring additional rental charges. The account balance as of October 12, 2011 was $150,172.

 

On November 15, 2021, Plaintiff filed the instant action.

 

On September 21, 2022, Defense Counsel filed the instant application.

 

Discussion

 

Defense counsel seeks to be relieved because his clients are no longer communicating with him about the case. In fact, Defense Counsel explains he is unable to contact his clients. As the court granted the parties’ stipulation to continue trial until January 2023, the court finds minimal prejudice. To the extent there is prejudice, Defendants are to bear some responsibility for not communicating with their attorney.

 

Conclusion

Based on the foregoing, Defense Counsel’s Motion to Be Relieved as Counsel is GRANTED, effective upon the filing of proof of service of this court’s order relieving Counsel, sent to Plaintiff, Defendant, and all other parties who have appeared in the case.
