FOR DEFAULT JUDGMENT
Tentative Ruling
Plaintiff’s APPLICATION
FOR DEFAULT JUDGMENT is GRANTED.
Background
This is a collections case. Plaintiff DISCOVER BANK alleges
that Defendant NABA KAR AKA NABA K KAR is indebted to Plaintiff on an open book
account for a loan issued to Defendant. The fixed amount due is $36,763.28.
On April 14, 2022, Plaintiff filed suit against Defendant
and Doe Defendants for Common Counts.
On June 21, 2022, default was entered. That same day,
Plaintiff filed the instant application for default judgment.
Discussion
Plaintiff seeks default judgment against Defendant in the
total amount of $37,266.78, which includes the $36,763.28 as pleaded in the
complaint and $503.50 for costs.
Here, as Plaintiff has authenticated Defendant’s account and
all other requirements are met, the court GRANTS the application for default
judgment.[1]
Therefore, default judgment is entered in the amount of
$37,266.78.
[1] The
court also grants Plaintiff’s request to permit the use of copies in lieu of
the original agreement upon which the action is based.
