Defendant / Cross-complainant / Cross-defendant Xuandong Lin’s motion to disqualify Clark A. Braunstein, Esq. and his law firm Braunstein & Braunstein, PC. and Bin Li, Esq. and his law firm the Law Offices of Bin Li, PLC from continuing to represent Plaintiff, Global Student Housing, LLC in this action is DENIED. 

Moving Party has not adequately explained how the 4 ½ year delay in bringing this motion was reasonable.  (See Exhibits A-C to Ross Declaration.)  Granting such relief a mere four months before trial would result in undue prejudice to plaintiff.   (See Fiduciary Trust International of California v. Superior Court, 218 Cal. App. 4^th 465, 490 (2013))

Moving Party’s objections to the declaration of Bin Li are overruled.
