Defendant Benihana National Corp.’s motion to compel the deposition of plaintiff Adamaris Arrizon has been withdrawn. (ROA 158).
Moving party’s sanctions request is DENIED. There has been no showing why plaintiff Arrizon, a minor, should be liable for sanctions. Plaintiff Arrizon is represented in this action through a Guardian Ad Litem. (ROA 7).
Moving party’s request for trial continuance is DENIED. Moving party argues that it needs a continuance to file a motion for summary judgment, relying on Polibrid Coating, Inc. v. Superior Court (2003) 112 Cal. App. 4th 920. That case is distinguishable from this case. Here, moving party has been in this litigation since answering the complaint on September 30, 2020. (ROA 13). Polibrid had been in the case for 4 months before it requested a continuance to file a motion for summary judgment. Moving party has had sufficient time to bring an MSJ.
