Plaintiff Joan Lejeune’s motion to compel the deposition of Defendant Albertson’s LLC’s employee, Donna Maier, is DENIED as MOOT.

Pursuant to the Herzog Declaration, signed under oath, Donna Maier is deceased.  Accordingly, there is nothing to compel as the court does not have the power to compel this particular deposition. 

Plaintiff’s request for sanctions is DENIED.

Plaintiff shall give notice.
